BANKRUPTCY

Our Forensic & Valuation Services Group has provided a broad range of assistance for parties involved in Chapters 11 and 7 proceedings.

For debtor: assistance during the reorganization process to improve the prospects for successful emergence from bankruptcy protection. Services range from determining short-term cash flow requirements and managing the use of current assets, to negotiating with creditors and preparing reorganization or liquidation plans.

For secured creditors:  services that include determining the value of the secured creditor’s collateral, and evaluating whether it is being used by the debtor to impair its value or improve the position of other creditors to the detriment of the secured creditor. We can also assist in restructuring of the obligation, and determining if reorganization or liquidation plans provide fair treatment for the creditor’s claims.

For unsecured creditors:  assistance for creditors and their counsel in sorting through the vast quantity of data to develop meaningful answers and strategy. Services include determining debtor solvency at times prior to the actual bankruptcy, fraudulent conveyance analysis, and valuation of non-core intellectual property and other assets than can be liquidated.

For trustee/receiver: assistance in managing the process of either turning a company around, or engaging in an orderly liquidation of the company’s assets. Other services include business status evaluations, management and control of documents, plus cost cutting and improving cash flow. We have also served as trustees, receivers and examiners.
